SwingSnap Terms of Service

Please read these Terms and Conditions carefully before accessing or using the SwingSnap Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section.

1.2 Definitions

  • Application means the mobile application titled “SwingSnap – AI Golf Swing Analyzer,” including all related features and updates.
  • Company, We, Us, or Our means SJ Ventures, a company registered in the Netherlands, with registered office at Jacob van Lennepstraat 31-1A, 1053HB Amsterdam, The Netherlands.
  • Service means the Application, Website, associated software, AI tools, and services offered by the Company.
  • User Content means swing videos, photos, text, metadata, or other content uploaded or submitted by You.
  • Website means swingsnap.io.
  • You means the individual using the Service.

2. Agreement to Terms

Your use of the Service is conditioned on Your acceptance of these Terms and Our Privacy Policy. If You do not agree, You must stop using the Service.

3. Eligibility; Age Requirements

You must be at least 13 years old. Users aged 13–17 may only use the Service with the consent and supervision of a parent or legal guardian.

4. AI Analysis and Sports Disclaimers

SwingSnap provides AI-powered golf swing analysis only. All feedback, metrics (speed, angles, path, etc.), and recommendations are automated approximations and may be inaccurate.

  • The Service is not professional golf instruction, coaching, or medical advice.
  • Incorrect analysis can lead to bad habits or injury.
  • Always consult a qualified PGA professional or coach before making technique changes.
  • We are not liable for any inaccuracies or for any injury, loss, or damage resulting from reliance on the Service.

5. User Content; License Grant

By submitting User Content, You grant Us a worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, process, modify, and create derivative works from Your User Content solely to operate and improve the Service (including anonymized AI training).

You agree not to upload unlawful, harmful, or infringing content.

6. Prohibited Uses

You may not: reverse engineer the Service, upload violent/explicit content, circumvent security, or interfere with the Service.

7. Subscription, Billing, and In-App Purchases

Purchases and subscriptions are processed via the Apple App Store. Their terms govern payments and refunds.

8. Third-Party Services

The Service may link to third-party services. We are not responsible for them.

9. Intellectual Property

All rights in the Service (excluding Your User Content) belong to Us. You may not copy, modify, or reverse engineer the Service.

10. Termination

We may suspend or terminate Your access for violation of these Terms.

11. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided without warranties of any kind.

12. Limitation of Liability

To the maximum extent permitted by law, Our total liability shall not exceed the amount You paid in the preceding 12 months (or €100 if no payment was made). We are not liable for indirect or consequential damages.

13. Governing Law

These Terms are governed by the laws of the Kingdom of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, The Netherlands.

14. Changes to These Terms

We may update these Terms. Material changes will be notified. Continued use constitutes acceptance.
